Our mission is to provide seamless, top-tier web management that ensures your digital presence is always at its best. By subscribing to Studio Malt Managed Web Services, you are partnering with a trusted team dedicated to delivering exceptional performance, security, and support for your website.
This page outlines the terms and conditions that govern your use of Studio Malt Managed Web Services’ services. It is important to read and understand these terms, as they define your rights and responsibilities as a Studio Malt Managed Web Services client. 1. Services Provided
Studio Malt Managed Web Services offers a comprehensive suite of web management services in a range of packages, including:
- Web hosting
- Web plugin maintenance
- Management of daily backups
- WordPress performance and security monitoring and protections, including malware monitoring and free removal
- Downtime and application monitoring
- Advanced logging
- Domain name and DNS management
- Automatic SSL renewals
- Free site migrations (as applicable)
Optional add-ons include:
- WooCommerce performance and security enhancements
- Additional WordPress performance enhancements by NitroPack
- AdditionalSecurity enhancements by CloudFlare
- Additional support hours per month, including monthly sync meetings with the Studio Malt team and monthly custom reporting
2. Subscription and Payment
- Subscription Packages: Studio Malt Managed Web Services is offered on a monthly subscription basis. Clients can choose from various plans based on their specific needs.
- Payment: Subscription fees are billed monthly. Payments must be made in advance to maintain service continuity.
- Additional Charges: Any optional add-ons or additional support hours will incur extra charges, which will be billed separately.
3. Client Responsibilities
- Accurate Information: Clients must provide accurate and up-to-date information during the subscription process and update this information as necessary.
- Compliance: Clients are responsible for ensuring their use of Studio Malt Managed Web Services’ services complies with all applicable laws and regulations.
- Content: Clients retain ownership of all content they upload or manage through our services. Studio Malt is not responsible for any content posted by clients.
4. Service Level Agreement (SLA)
- Uptime Guarantee: We strive to provide 99.9% uptime for our hosting services. However, occasional downtime may occur for maintenance or unforeseen issues.
- Support: Our team is available to assist with any issues related to Studio Malt Managed Web Services’ services. Clients can contact our support team through designated channels for prompt assistance, Monday to Friday, 9:00am to 5:00pm Australian Eastern Time.
5. Web Hosting
Studio Malt Managed Web Services provides reliable web hosting services designed to ensure optimal performance and security for your website. By utilising our web hosting services, you agree to the following terms:
- Resource Usage: Clients must use the hosting resources provided in a manner that ensures fair and equitable usage among all clients. Excessive resource usage that adversely affects other clients’ services may result in temporary restrictions or additional charges.
- Prohibited Activities: Clients are prohibited from using the hosting services for illegal activities, including but not limited to:
- Distribution of malware or other harmful software
- Hosting of illegal or unauthorised content, such as copyrighted material without proper authorization
- Engaging in spamming or other forms of unsolicited communication
- Conducting any activities that violate local, state, national, or international laws
- Data Security: Studio Malt implements industry-standard security measures to protect your data. However, clients are responsible for maintaining their own backups and ensuring their data is secure.
- Backup Policy: Studio Malt Managed Web Services performs daily backups of all hosted websites. In the event of data loss, Studio Malt will assist with data recovery based on the latest available backup. However, we cannot guarantee full data recovery in all circumstances.
6. Additional Support Hours
- Monthly Top-Up: Additional support hours are topped up monthly, providing clients with a set number of hours for extra support services.
- Drawdown: Support hours are drawn down as they are used. Clients can monitor their usage through their account portal.
- Excess Hours: If clients exceed their allotted support hours within a month, the excess hours will be billed at the end of the month at the standard hourly rate.
- Unused Hours: Any unused support hours do not roll over to the next month and will expire at the end of the current billing cycle.
- Monthly Sync Meetings: Clients who subscribe to additional support hours will have access to monthly sync meetings with the Studio Malt team to review progress and address any concerns.
- Custom Reporting: Monthly custom reporting is available to clients who subscribe to additional support hours, providing insights and analytics on their website’s performance and security.
7. Termination and Cancellation
- Termination by Client: Clients can cancel their Studio Malt Managed Web Services subscription at any time. Cancellations will take effect 30 days from the notice of termination.
- Termination by Studio Malt: Studio Malt reserves the right to terminate a client’s subscription for violations of these terms or any misuse of our services. In such cases, no refunds will be provided.
- Refund Policy: Refunds are not offered for partial months of service or for unused services.
8. Limitation of Liability
Studio Malt shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use our services. This includes, but is not limited to, damages for loss of profits, data, or other intangible losses.
9. Modifications to Terms of Service
Studio Malt reserves the right to modify these terms of service at any time. Clients will be notified of any significant changes. Continued use of Studio Malt Managed Web Services’ services after such modifications will constitute acceptance of the new terms.
10. Privacy Policy
Our commitment to your privacy is outlined in our Privacy Policy. By using Studio Malt Managed Web Services’ services, you agree to the collection and use of your information as described in our Privacy Policy.
11. Governing Law
These terms of service shall be governed by and construed in accordance with the laws of the state of Victoria, Australia. Any disputes arising from these terms shall be resolved in the courts of Victoria.
